General sales conditions
These general conditions of sale (CGV) are agreed between Quinta da Mariposa, Lda, with registered office at Rua da Rodela 17 3430-086 Carregal do Sal, registered at the Commercial Registry Office of … with the Registration and Individual Identification number 513646493 and hereinafter referred to as “Quinta da Mariposa, Lda” and people who wish to make purchases through the Quinta da Mariposa, Lda website – www.quintadamariposa.pt hereinafter referred to as “User”.
These conditions apply exclusively to natural persons who are not traders, meaning any natural person who acts for purposes that do not fall within the scope of their professional activity.
The parties agree that purchases made through this website will be governed exclusively by this contract to the exclusion of any conditions previously available on the website.
1 – OBJECT
The purpose of these general conditions of sale is to provide and define all the information necessary for the user regarding the ordering, selling, payment and delivery methods for purchases made on the website.
These conditions regulate all the steps necessary to place the order.
These general conditions will not apply if it turns out, due to the type of order, that the User is not a final consumer as defined in paragraph c) of article 3 of Decree-Law no. 24/2014, of 14 of February.
2 – ORDER
The User can order products on the website, selecting them and adding them to the shopping cart.
To place the order, you must complete the requested information and choose the options made available to you throughout the process (delivery method, address, email, payment method, as well as the NIF and the name that, for tax purposes, you want appear on the invoice).
When placing the order, it is equivalent to full and complete acceptance of the prices and description of the products available for sale as well as the general conditions of sale, which will be the only ones applicable to the contract thus concluded.
When placing the order, the User agrees to receive the invoice electronically, in accordance with art. 12, no. 1 of Decree-Law no. 28/2019, of 15 February.
Quinta da Mariposa, Lda will honor orders received online only up to the limit of available stocks, in the absence of product availability, Quinta da Mariposa, Lda undertakes to inform the User as soon as possible.
The data contained in the invoice is the sole responsibility of the User.
The validity of orders depends on the payment method. In the case of payment by ATM or transfer, if it is not confirmed after 48 hours, the order will be cancelled.
3 – DELIVERY
Quinta da Mariposa, Lda offers two delivery methods, which the User can choose when placing the order.
Shipping costs vary according to the delivery method selected by the User and may, at any time and without prior notice, be changed by Quinta da Mariposa, Lda. To find out the shipping costs for an order, the User must add Add the products you want to purchase to your shopping cart and choose the delivery method.
No deliveries are made to Post Offices.
For each product, the expected deadline, in business days, for its dispatch is shown. These deadlines are merely indicative.
Quinta da Mariposa, Lda will always strive to meet the estimated delivery deadlines but, if it foresees difficulty in meeting the delivery deadlines, it will inform the User of this, providing them with the option to terminate the contract. By not activating this right, we assume that the User remains interested in the order and consents to delivery beyond the aforementioned period.
To monitor an order in progress, the User can check its status by following the tracking code sent by the carrier.
4 – PAYMENT AND ORDER VALIDATION
In accordance with paragraph j) of paragraph 1, of article 4, of Decree-Law nº24/2014. of February 14th, amended by Law No. 47/2014, of July 28th and by Decree-Law No. 78/2018, of October 15th, Quinta da Mariposa, Lda offers the User the following payment methods:
ATM
The Multibanco reference generated remains active for up to 48 hours, being deactivated after this period.
MBWAY
Payment via MBWAY remains active for up to 5 minutes, being deactivated after this period.
Payment by Transfer
The transfer will be made to the data sent after the order.
Quinta da Mariposa, Lda will use all its efforts to guarantee maximum confidentiality and security in data transmitted over the internet.
For your order to be accepted and validated, payment must be made within the terms and deadlines set out in paragraph 2 hereof.
After confirming receipt of payment, and within a maximum period of forty-eight hours, an email will be sent confirming the validation of the order. The email will be sent to the email address indicated by the User.
5 – PRICES
Prices must be understood in Euros, with fees and taxes included, taking into account the VAT in force on the date of payment of the order.
If there is a change in the price lists of products for sale on this website, this situation will require an update of the advertised prices. If this situation occurs, it will not affect orders already registered.
The prices shown always correspond to the most up-to-date prices in force, however, they should only be considered valid while they are visible on the website on a refreshed page (cache or non-refreshed pages may show prices that are no longer in force). The price shown is only guaranteed under these conditions and only after the order is duly registered and paid in accordance with the payment conditions set out in these Terms and Conditions (no. 6 of Article 2 and no. 1 of this article).
6 – DISCOUNTS
On the Quinta da Mariposa, Lda website there are several promotional price proposals, in the form of percentage discounts on the retail price, which can be seen on various products.
All promotions have a specific period of validity, which can be found on the website.
Promotional discounts represent a commitment during the advertised period, but always on the condition that the order is completed by the User, through “checkout” and the respective payment, by the end of that period.
Saving a product in the “shopping basket” does not guarantee its price or discount.
7 – GUARANTEES
In the event of a manufacturing defect, the User has the rights provided for in Decree-Law no. 67/2003, of April 8, amended by Decree-Law no. , are subject to a two-year legal guarantee.

8 – RIGHT TO FREE RESOLUTION
Under the terms of Decree-Law No. 24/2014, of February 14, the Customer has 14 days after receiving the products to terminate the contract and return them. The aforementioned 14-day period will be suspended during the State of Emergency.
To make a return, the User can do so directly through the CTT carrier. Alternatively, you can return it to a Quinta da Mariposa, Lda store, by contacting Quinta da Mariposa, Lda in advance via email luciafreitas@quintadamariposa.pt.
The product must be in perfect condition and be returned, without signs of use, in the original packaging.
If the right to free resolution is exercised within the aforementioned period, only the price of the Product(s) purchased and shipping costs will be refunded. The return costs are borne by the User, if they wish to return the product(s) in a different and more expensive delivery method than the commonly accepted and less expensive method proposed by Quinta da Mariposa, Lda.
Exercising the right of free resolution, this must be done by delivering the annex contained in part B of Decree-Law nº24/2014. of February 14th, amended by Law No. 47/2014, of July 28th and by Decree-Law No. 78/2018, of October 15th, in accordance with paragraph l.
The refund will be made using the same payment method used by the User in the initial transaction, unless expressly agreed otherwise and without additional costs as a consequence of such refund.
Quinta da Mariposa, Lda, as long as the products are not received or as long as the User does not provide proof of their return, may withhold the refund.
In the case of a return, the amount will be refunded via bank transfer to the account indicated by the User.
Exclusion of the Right to Free Termination: There is no right to free termination of the contract in the following situations:
Supply of products that, by nature, cannot be returned or are likely to deteriorate or quickly expire.
9 – EXCHANGES
If the value resulting from the exchange of products in an order is higher than the initial value of the order, the User will have to pay the difference.
If an exchange is made for a product with the same value, the User will not incur any additional cost.
Exchanges for products of lower value are not permitted.
Items sent free of charge, in the form of a complement, gift or bonus, will not be refunded;
To products purchased by the User within the scope of these GCS, being considered consumer goods, the rules established by DL 67/2003 of April 8 (Guarantee regime for consumer goods) will apply, with the necessary adaptations.
10 – COMPLAINTS
The User may submit their complaints to Quinta da Mariposa, Lda via post to Avenida Alberto Sampaio 154, 3510-028 Viseu

11 – RESPONSIBILITY
Quinta da Mariposa, Lda is not responsible for any inconvenience or damage caused to the User by the use of the Internet network, such as: service disruption, external intrusion, anomalies caused by computer viruses or any other case of force majeure.

12 – NEWSLETTER Quinta da Mariposa, Lda
The name Quinta da Mariposa, Lda Newsletter is given to e-mailings with promotions, offers and information, sent directly to the User’s email box provided to Quinta da Mariposa, Lda when the User registers.
Users have the option of subscribing to the Newsletter and are automatically registered from the moment they place their first online order.
To modify your personal data or suspend the request to send the Newsletter, you must go to your registration and deactivate this option.
13 – TEST
The Parties agree that computerized records, kept in the computer systems of Quinta da Mariposa, Lda under reasonable security conditions, provide proof of communications, orders and payments made between the parties.
14 – STORAGE AND ARCHIVE OF TRANSACTIONS
Orders and invoices will be archived on a reliable and durable medium to provide a faithful and durable copy.
15 – APPLICABLE LAW AND COMPETENT JURISDICTION
The law applicable to any contractual relationship established through the Quinta da Mariposa, Lda. website is Portuguese law.
To resolve any and all conflicts arising from any contract concluded under these general conditions of sale, Portuguese law will apply, with its courts having exclusive jurisdiction to resolve disputes. General Conditions of Sale updated on 7/29/2014
